Terms & Conditions
By engaging Olivier Studios in any capacity you are agreeing to the following terms & conditions.

1. Engagement
By approving a quote and/or paying a project deposit, the Client agrees to the following terms of trade.
2. Payment Terms
A non-refundable 50% deposit is required to confirm the project.
Remaining payment is due upon completion, prior to final file delivery.
Extended payment plans may be agreed upon in writing.
Late payments incur a 10% late fee after 7 days, and an additional 2% per 30 days thereafter.
3. Intellectual Property & Usage
Final deliverables are transferred to the Client upon full payment.
Working files, unused concepts, and source files remain the intellectual property of Olivier Studios and are not included in the final handover.
Should the Client wish to obtain working files, this can be arranged for an additional percentage-based fee per file.
Olivier Studios reserves the right to showcase final and draft work in our portfolio, socials, and promotional materials unless a written NDA is in place.
4. Timeline, Rush Fees & Delays
Project timelines are estimated based on prompt feedback. Delays in communication may result in the project being rescheduled or placed on hold.
Projects inactive for more than 20 days without communication may be terminated, with all paid amounts retained as well as time to date invoiced.
If the Client requires an expedited timeline, urgent fees may apply, which will be outlined in the proposal or agreed upon in writing.
5. Client Responsibility
Clients are responsible for proofing all content and materials before final approval.
Olivier Studios is not liable for spelling, grammatical, factual, or design errors once the final artwork has been approved.
6. Revisions
Each project includes a set number of refinements (as outlined in your proposal).
Additional changes outside of scope or after final approval will be billed at our current hourly/project rate.
7. Cancellations & Refunds
The 50% deposit is non-refundable.
Should a project be cancelled after commencement, time spent will be billed accordingly.
No refunds are offered after design work has begun.
8. Limitation of Liability
Olivier Studios is not responsible for indirect losses, profit loss, or damages resulting from use or misuse of final assets.
Maximum liability will not exceed the project total paid to date.

9. Scope of Work
Includes core brand identity assets such as logo(s), colour palette, typography, brand guidelines, and any agreed collateral.
All deliverables and inclusions will be clearly outlined in the project proposal.
10. Ownership
Upon full payment, the Client receives ownership of the final, approved brand assets.
Working files (e.g., Illustrator files, unflattened logo variations, exploration files) are not included unless explicitly agreed.
11. Unused Concepts
All unused or unapproved concepts remain the property of Olivier Studios and may be repurposed or reused.
12. Concept Approval & Finalisation
Once a concept direction is approved by the Client (e.g., a logo or visual identity), any major changes to the concept after approval will be considered outside of scope and may incur additional charges. This includes changes to the overall design direction, style, or complete reworks.
13. Font Licensing
Olivier Studios uses fonts that are either commercially licensed or free for commercial use. Any fonts used in your brand may require a separate commercial license if you wish to use them beyond the assets provided (e.g., in your own design work, Canva, or internal tools).
It is the Client's responsibility to purchase their own font licenses if extended use is required.
Olivier Studios can assist in sourcing or recommending licenses, but is not responsible for copyright infringement resulting from the Client’s misuse.
14. Logo File Formats & Usage
Final logo files will be provided in multiple formats (e.g., .SVG, .PNG, .PDF) suitable for digital and print use.
It is the Client’s responsibility to store and back up these files once delivered.
Olivier Studios is not responsible for file retrieval after 30 days unless a hosting/retainer arrangement is in place.
15. Sub-brands & Additional Variations
The branding package includes the agreed primary and secondary logo variations (as per your proposal).
Sub-branding, event logos, seasonal adaptations, or alternative lockups are considered additional and will be quoted separately.
16. Canva Templates & Editing Limitations (optional, if you offer these)
If templates are delivered in Canva, some design or layout limitations may apply.
Olivier Studios is not liable for alterations made by the Client that compromise the design, formatting, or visual consistency of the templates.

16. Platform
We’ll design your website using platforms like Squarespace or Shopify, as agreed in your project scope.
If you decide to switch platforms during the project, we may need to revise the scope, which could lead to additional costs.
17. Hosting & Domains
You’ll be responsible for managing and renewing your domain name, hosting, and platform subscriptions.
Costing for website & domain hosting is not included in the quote and is to be organised by the client.
While we can help guide you with some initial steps, Olivier Studios isn’t liable for any issues that arise from third-party platforms or their policies.
18. Go-Live & Testing
We will ensure your website is tested for both mobile and desktop devices to make sure everything works smoothly.
However, the final decision to go live is yours. Any post-launch tweaks or changes may incur additional costs unless otherwise agreed upon.
19. SEO & Performance
We will set up basic on-page SEO, which helps search engines find your site.
For more in-depth SEO services or ongoing optimization, we recommend working with a dedicated SEO expert.
Your site will be optimized for performance, but external factors like third-party apps or content you provide can impact how quickly the site loads.
20. Accessibility
We will design your website with accessibility in mind, but please note we aren’t accessibility specialists.
Full accessibility compliance requires ongoing attention, and we recommend working with an accessibility expert if this is important for your site’s ongoing success.
21. Browser Compatibility
Your website will be designed to work on the latest versions of popular browsers like Chrome, Safari, Firefox, and Edge.
We do not support older browsers (e.g., Internet Explorer), and any fixes or adjustments needed for outdated browsers will be treated as additional work.
22. Responsiveness
Your website will be responsive, meaning it will adapt to work well on standard mobile, tablet, and desktop sizes.
If you need support for custom screen sizes or have special requests, please let us know in advance so we can discuss options.
23. Website Performance
We will make sure your website is optimized for fast performance, including image optimization and mobile responsiveness.
However, certain factors outside our control, like third-party apps, hosting settings, or content you provide, can affect performance.
We’re not responsible for these external factors unless we’ve specifically agreed to handle performance optimization as part of the project.
24. Training & Handover
Once your website is ready, we’ll provide a walk-through training and handover materials so you can confidently manage and update your site with ease.
If you need further training or have questions about advanced features, we can provide additional sessions for an extra charge.
25. Maintenance & Updates
Olivier Studios doesn’t offer ongoing website maintenance as part of the regular project. If you require updates after launch, we’ll be happy to assist on a quoted basis.
26. Domains, Hosting & Third Parties
You’re responsible for purchasing and maintaining your domain and hosting services.
We’ll provide you with the necessary details to connect your domain to the platform, but we do not offer direct technical support for domains or third-party services.
We aren’t liable for any downtime, technical issues, or losses caused by third-party providers.
27. Platform Limitations
We will build your website based on what the chosen platform can offer.
Some design or functionality requests may not be possible within the platform’s limits and may require extra development or third-party tools, which would be outside of the original scope and budget.
28. Third-Party Integrations
If your website requires integration with third-party platforms (such as email marketing, booking systems, or payment gateways), we’ll assist with the setup if it’s included in the scope.
We can’t control the performance or updates of third-party services once integrated, and we’re not responsible for ongoing issues.
29. Client-Provided Content
To keep your project on track, we’ll need you to provide all the necessary content upfront, including branding elements, images, and copy.
If you’d like to work with a copywriter before we begin, please arrange that separately.
Unless otherwise specified in your quote, the design and development work we do doesn’t include copywriting or providing images.
30. Web Font Files for Custom Fonts
If your website requires the use of custom brand fonts, you’re responsible for purchasing and providing the necessary font files (e.g., web-safe font licenses).
We’ll integrate them into the design, but please note that we are not responsible for any licensing issues or fees associated with custom fonts.
If you need assistance with font licensing or sourcing, we’re happy to help, but this may incur additional costs.

31. Consultancy & Ideas
During the branding consultancy phase, Olivier Studios will provide creative suggestions, concepts, and strategies based on our expertise.
All ideas and recommendations are provided for your consideration only. While we offer these insights with the best intention, any implementation of these ideas is at your own discretion.
Olivier Studios is not liable for the outcome or success of the ideas, strategies, or concepts once they are put into practice by you.
32. Client Decisions & Responsibility
The final decision regarding the direction, design, and execution of the branding strategies, concepts, and ideas lies solely with the client.
Olivier Studios will not be held responsible for any outcomes resulting from these decisions, including but not limited to business impact, brand perception, or market response.
33. No Liability for Unapproved Ideas
Olivier Studios is not liable for any loss, damage, or costs arising from ideas or strategies presented during the consultancy phase.
While we will always advise with the utmost care and expertise, any changes or decisions made outside of the agreed-upon scope of work are at the client's own risk.

34. Print Files & Colour Accuracy
Olivier Studios will provide print-ready files based on standard printer specifications, which are prepared to ensure compatibility with most printers.
Print quality and colour reproduction cannot be guaranteed unless you are working with us under a print management service.
Our quotes include design and print-ready files only.
Printing costs or print management services are not included unless otherwise specified.
If you require assistance with printing or print management, additional costs may apply.
We recommend:
Working directly with a printer to ensure the best results.
Getting test prints or physical proofs to confirm colour and quality.
Understanding that factors such as paper stock, texture, finish, and printer calibration can all influence the final colour and print quality.

35. Content Responsibility
The Client is responsible for providing all necessary content for packaging design, including but not limited to product names, descriptions, ingredients, nutritional information, legal disclaimers, barcodes, and any other text or information that must appear on the packaging.
Olivier Studios is not liable for any errors, omissions, or inaccuracies in the content provided by the Client.
36. Legal Disclaimers & Compliance
While Olivier Studios can provide design services for packaging, it is the Client’s responsibility to ensure that all legal disclaimers, ingredient lists, and regulatory requirements are correct and compliant with relevant laws.
Olivier Studios will not be held responsible for any legal or compliance issues resulting from incorrect or incomplete content provided by the Client.
37. Final Approval
The Client must approve the final design files for packaging before any production or print is initiated.
Any changes or updates to the design after final approval may incur additional charges for revisions.
38. Print-Ready Files
Olivier Studios will deliver packaging designs as print-ready files suitable for the Client’s specified printer.
The Client is responsible for coordinating directly with the printer to ensure that the final product meets their expectations regarding print quality, colour reproduction, paper stock, texture, and finish.
39. Colour Accuracy & Print Quality
While every effort will be made to ensure colour accuracy in packaging designs, Olivier Studios cannot guarantee the final print quality or colour reproduction.
Variations in colour may occur due to differences in printer calibration, paper stock, finish, and other factors.
To mitigate any risk, the Client is encouraged to request test prints or physical proofs from their printer before full production.
40. Content Revisions & Additional Costs
Any revisions to packaging content after the final design has been approved will incur additional charges.
This includes updates to product information, legal disclaimers, or other content.
Additional charges may apply for any content revisions, updates to quantities, or significant design alterations.
41. No Responsibility for Printing Process
Olivier Studios is not responsible for the printing process itself, including issues that may arise during production, such as colour discrepancies, material issues, or delays.
The Client is responsible for managing their relationship with the printer and ensuring that the printed product aligns with their expectations.
42. Third-Party Suppliers & Services
If any third-party services (such as print management, copywriting, or legal consultation) are required in the packaging process, the Client is responsible for securing and managing those services independently unless otherwise specified in the project scope.
Olivier Studios is not liable for any third-party errors or delays.
